You do not have to decide everything today.
Selling, keeping the home or pausing while you gather facts each raises different questions. Explore the topics to take to your professional team.
Start with the property facts and the required approvals.
- Ask your attorney what agreements or court orders affect listing, offers, access and the handling of proceeds.
- Review a market-based price range and a seller-net estimate with Annette. A price opinion is not a legal determination of value.
- Agree on showing communication, property preparation and decision-making before the home goes on the market.
A buyout is more than deciding on a price.
- Have your attorney advise on ownership, settlement terms and the documents required.
- Ask the lender whether refinancing or an approved assumption is possible. Changing a deed alone does not remove a borrower from a mortgage.
- Compare the ongoing mortgage, taxes, insurance and maintenance with a realistic budget. A lender decides financing eligibility.
You can gather information before choosing a direction.
- Collect the mortgage balance, property-tax bill and known home-condition information.
- Ask Annette for real estate market context and discuss the likely preparation and sale timeline.
- Review the options with your attorney and financial or tax adviser before making commitments.
Clear roles. Less crossed communication.
Real estate decisions should support your legal and financial plan, not replace it.
Annette's role
Discuss comparable sales, market preparation, marketing and the real estate transaction. The representation arrangement, communication plan and authorized decision-makers should be clear from the start.
Your attorney's role
Advise on your rights, agreements, court requirements, property division and who can approve or sign documents. Annette does not make legal decisions or allocate proceeds.
Lender, title & tax advice
Your lender determines borrowing options. The title team handles its closing responsibilities. A qualified tax adviser explains tax consequences for your circumstances.
A practical starting checklist.
Gather what you can. Do not upload court papers, financial records or other sensitive documents to a general website form.
Use this as a personal checklist. Nothing is submitted or saved when you check an item.
Questions about the home during a divorce.
These are general planning points, not advice about a particular case.
Does a divorce mean we have to sell?
Not necessarily. The appropriate path depends on the ownership, financing, agreements and any court requirements. Review those with your attorney before deciding.
Can a deed change remove someone from the mortgage?
Not by itself. Ownership documents and the loan obligation are different. Ask the lender what is required to release a borrower, refinance or approve an assumption.
Will Annette decide how sale proceeds are divided?
No. Distribution must follow the governing agreements, closing instructions and legal requirements. Your attorney advises you on those matters.
How should we handle showings and communication?
Establish a workable communication and access plan consistent with attorney guidance and any relevant orders. Confirm the scope of representation and who has authority to approve each step.
Start with the real estate questions.
Annette can help you understand the property and market side while you work with your attorney and other advisers on the bigger decisions.
